Terms & Conditions for Booking Performers

These Terms and Conditions outline the agreement between Can’t Stop The Fun Events (the "Company," "We," or "Us") and the client ("You" or "The Client") regarding the booking of performers for events in the UK. By booking our performers, you agree to the following terms:
1. Booking & Payment
1.1 Booking Confirmation
All bookings are subject to availability and are only confirmed upon receipt of a signed contract and a deposit (if applicable).
A detailed booking form, including event details, location, and performance requirements, must be completed before confirmation.
1.2 Deposit & Fees
A non-refundable deposit of 20% of the total fee is required at the time of booking to secure the performers.
The remaining balance must be paid no later than 14 days before the event unless otherwise agreed.
Late payments WILL be subject to additional fees of £40, then an additional 8% (under the Late Payment of Commercial Debts Interest Act 1998) for every day until payment has been received.
2. Cancellations & Refunds
1. Weather Disclaimer
Unpredictable Nature of Weather:
The parties acknowledge and agree that weather conditions are inherently unpredictable and can impact the performance, timing, and outcome of the agreed-upon services and obligations under their contract with Can’t Stop The Fun Events.
Impact on Obligations:
Can’t Stop The Fun Events shall not be held liable for any delays, failures, damages, or losses resulting directly or indirectly from weather-related events, including but not limited to natural disasters, extreme weather conditions, or any other 'Act of God' that are beyond the control of Can’t Stop The Fun Events.
Notification and Mitigation:
In the event of adverse weather conditions that may affect the performance of the services or obligations, Can’t Stop The Fun Events shall promptly notify the Client. Can’t Stop The Fun Events shall take reasonable steps to mitigate the impact of such weather conditions on the performance of its obligations, including rescheduling, if necessary.
3. Performance Requirements
3.1 Event Conditions
The Client must provide a safe and suitable performance space, including a flat surface for dancers, fire safety precautions (if applicable), and proper access for all performers.
Performers must have access to a secure changing area and drinking water throughout the event.
If the event is outdoors, adequate weather protection must be provided for the performers and equipment.
3.2 Technical & Power Requirements
If LED performances are booked, The Client must provide sufficient power supply for charging equipment.
Sound and lighting should be set up according to agreed requirements before the performance.
4. Health & Safety
The Client must ensure a safe working environment for performers, including:
No hazardous surfaces (e.g., wet or uneven floors).
No unauthorized persons interfering with the performance.
Emergency contact details for event staff.
The Company holds Public Liability Insurance, but The Client is responsible for obtaining event insurance if required.
5. Photography & Media
The Client may take photos and videos for personal use, but commercial use (e.g., advertising or reselling footage) requires written permission.
We reserve the right to take promotional footage at the event, but we will respect any confidentiality agreements.
6. Force Majeure
Neither party shall be liable for delays or cancellations due to unforeseeable circumstances such as extreme weather, public emergencies, strikes, or government restrictions.
Weather-related events that constitute force majeure as defined in the Force Majeure clause of the contract shall be governed by the terms specified therein. Can’t Stop The Fun shall not be deemed in breach of the contract if the failure to perform is due to such weather-related force majeure events.
Client/Customer Acknowledgment: The Client/Customer acknowledges the inherent risks associated with weather conditions and agrees to indemnify and hold harmless Can’t Stop The Fun from any claims, damages, or losses arising out of or in connection with weather-related events, except where such claims, damages, or losses are directly attributable to the gross negligence or wilful misconduct of Can’t Stop The Fun Events.
No Refunds Policy:
The Client/Customer acknowledges and agrees that in the event of any weather-related disruption or cancellation of services, no refunds shall be issued by Can’t Stop The Fun Events on the day of the event. Can’t Stop The Fun may, at its sole discretion, offer alternative arrangements or reschedule services impacted by adverse weather conditions. This Weather Disclaimer and No Refunds Clause shall be read in conjunction with the other terms and conditions of the contract, and in case of any conflict, this clause shall prevail to the extent of matters pertaining to weather-related events and the no refunds policy. If the stage area is deemed not suitable for the artist to perform safely, the perform hold the right to cancel and be paid if full if the client has provided the wrong information. If the performer cancels within 7 days before the event, the client may request a full refund (EXCEPT FOR ILLNESS ON THE DAY)
7. Agreement & Jurisdiction
These terms are governed by UK law.
Any disputes shall be resolved through negotiation or, if necessary, through UK courts.
Acknowledgment & Acceptance
By booking performers from Can’t Stop The Fun Events, The Client agrees to these Terms & Conditions.
